How To File Employment Claims

By: Lindsay Nolan

When someone is injured at work, they may not know where to begin to seek compensation. Fortunately, there is help available. You don't have to embark upon the sometimes lengthy legal process with all of its complexities and paperwork alone. You can have the assistance of an experienced employment claims attorney. You may say, “I can't afford an attorney. I am trying to stay afloat after this accident.” You don't have to pay upfront legal fees if you use a 'no win no fee' payment arrangement. In this case, your attorney will only receive payment at the end of the case as a percentage of your compensation package. You don't have to front money to get the legal professional's assistance.

An employer must keep the work place safe and secure. After you are injured because of someone else's fault, you may have a good case for monetary compensation. The company you work for must provide the following items:well running and maintained equipment; appropriate training and all training materials; safe walk ways, including stairs, ramps, side walks, roads, and any other walking surface; hand rails and barriers; proper storage and handling of hazardous chemicals and waste; adequate facilities for rest and meals; safety equipment and safety clothing; and operating and maintenance manuals.

After a work related injury, get the necessary medical treatment if you need care. Be sure to call an ambulance if you or anyone else needs to be seen by a medical professional immediately. First aid is necessary to reduce the possibility of long term effects. An employer should have emergency plans and first aid available. If you have a chemical spill, you need to follow the instructions treatment for that chemical exposure. For example, if you must cleanse your eyes, an eye wash station should be available near the place where the chemical is kept. Safety showers must be provided to wash off chemicals when the skin is exposed. Remove spilled chemicals immediately, regardless of sensitivity regarding embarrassment or lack of privacy. Your skin will suffer more damage; the longer it is exposed to the chemical. Your health is the first priority.

Referrals may be helpful in finding a good attorney that you feel comfortable with. Attorneys often do free initial consultations. If your case is worthy filing a claim, you must answer questions with honesty and to give your attorney all of the information you can about the circumstances of the injury. Give your attorney any evidence you have gathered.

It may seem like too much trouble to start a legal process to file employment claims while you are dealing with your injuries, but this is the way to provide for yourself and your family in the midst of your difficulties. It is essential that you hold your employer responsible for their neglect. By choosing a good attorney, you cut down on the amount of work you will have to do to bring the case to completion and receive compensation for the damages you have suffered.
